If I join the guard do I have to forfit my
10% disability check I receive every month.
If so will I get it back automatically upon
ETS?

Yes. You will be asked to sign a waiver during your inprocessing into the Guard that states you have to choose which pay you will receive during your time in the Guard - either drill pay or VA disability pay. You can elect to receive normal drill pay or VA disability compensation during your time in the Guard, but for various legal reasons you cannot receive both. If your disability from the VA is rated at only 10%, that won't be that much money to lose - generally only about $30-50 per month. You would be wise to elect to receive drill pay in lieu of VA compensation as you're likely to be paid much more for a MUTA-4 than you would receive in VA compensation, and I don't know about you, but I'd much rather be busting my hump for drill pay instead of $30 a month in disability pay.

When you leave the Guard (at ETS) your VA disability pay should resume but don't expect to get any back-pay; it dosen't work that way. Good Luck.

I am currently serving in the AF Reserves. I receive my 10% disability check from the VA every month. You can serve with up to a 30% disability. Once a year the VA sends me some paperwork asking if I'm still in the reserves and then usually they keep one or two checks once a year. Since they move at less than barroom speed, I have gone a year or two without receiving anything from them. They are very hit or miss. I'm sure in the end that they will finally catch up after I have been retired for five years and demand a back payment. They will then withhold a percentage of your disability check for a couple of months then life will go back to normal.

Basiclly with the VA you roll the bones. They track the money as about as well as they track a veteran in the system.

Mortarman, are you saying that you can still serve at 30%? What if you are recieving Vocational Rehabilitation benefits too? Is that a hands down exclusion, or can you join once you have finished the Voc Rehab training?

OK, QUESTION. I WAS MEDICALLY DISCHARGED AND GIVEN A "3" CODE. ARE YOU SAYING I COULD STILL GET BACK IN AS LONG AS I HAVE 30% OR LESS DISABILITY?

I have a re-up code of 3 and a seperation code of JFL. I am currectly getting 30% from the VA. I WANT BACK IN! Please advise. Based on MMC post there is hope for me. I want to know.
