...and the Marines get a black eye, looking like bullies. Way to go, Jarheads!  My bet is that he'll win his appeal and his honorable discharge will be reinstated.

| Im very sure i read that somewhere in my contract (this was over 14 years ago lol) that you cannot wear a uniform, to any type of protest that your service deems not appropriate. (like gay rallies and anti government/war protests) while youre still in. if youre in the IRR, youre still in man. yea, he got a 214, but your contract says 8 year initial obligation. we all know what the word obligation means. if he can 'be called back' then he's still in. if youre within your FIRST 8 years, they can tell you what they want to. He should have remembered that. Though, it looks like he was trying to not misrepresent, and do any harm, by wearing a sterile uniform, he still misinterpreted it. im not sure what they should do to him, but they CAN do whatever they want. if youre outside of your 8 year MSO (military service obligation) and got your 214 for getting out, they can eat a di**. but if youre inside your MSO, i think they got ya. I'm not totally sure on this, but i think hes in trouble. Either way, I wouldnt change his discharge though. that could potentially ruin his entire life. Id recall him back on active duty, and do something then, if they decided to punish him. but dont ruin his life.

While on IRR you are not subject to the UCMJ. As far as I know even if they recalled him to active duty they couldn't prosecute him for this.

509Trooper (6/21/2007) While on IRR you are not subject to the UCMJ. As far as I know even if they recalled him to active duty they couldn't prosecute him for this.That was always my understanding.

Joesnuffy, the only way they could "touch" him would be through the UCMJ, which he was not subject to. Even Reservists/NG members in a drill status are not subject to the UCMJ unless they are on active duty orders.

| So if hes in the irr hes good? ok, i didnt know that. though, if they have the control to call him back, arent they still in 'control' then? I know the marines are pretty fanatical about, well, being fanatical lol. And youre not subject to the UCMJ on drill status?? Why do guys threaten others with article 15's while on drill weekend then?

I think drill status = active duty for the duration of the drill though I could be wrong about that since I was never in the Reserves or Guard... As for IRR, you are 100% civilian unless they call you back, at least that is how I always understood it
