Why would you want to go through all this and potentially lose your house? Just comply with the rules, the ones you signed. Put up a flag that complies with the rules just like you did when you were a Marine.

Follow the rules while they are enforced, at the same time work to get the concept of homeowners assoc ruled unconstitutional/illegal in violation of the property rights inherant to the capitalist society we live in. Death from within.

I thought I would stay out of it but I have to comment, there is nothing unconstitutional about the association or its rules. Trust me, the Supreme Court wouldn't even grant the appeal in order to hear arguments. Martin is dead on.

Valid point about him accepting the bylaws before he bought the house...

Still, I stand by what I said before. The whole concept sucks and I would never be a part of one. If I want to paint my house purple with green polkadots and flashing neon lights, then damnit thats what I'm gonna do... There is nothing, absolutely nothing, in the covenant that prevents him from flying a flag. He just can't have it on a pole in his yard. There is no constitutional right to have a pole in your yard. I'll bet after 9-11 everyone in that neighborhood was flying flags, in the manner I described above. This guy is simply trying to use his status as a veteran to evade the rules that everyone else has to play by.

Rules and laws are made to benefit the majority. Some cities have blight ordaniances and laws. It is ok if you are one breaking the rules or laws but what if you had a couple of gays living next door who wanted a pink house with a large dick painted on it. Would that be ok if they wanted something different? Laws protect everyone.
