Actually, according to public law 94-479 Congress granted the authority to Ford to appoint Washington his rank posthumously in 1976. It was approved on 11OCT1976 to take effect on 04JUL1976.

...And the first fleet was built in Whitehall, NY at the southern tip of Lake Champlain. Arnold successfully stalled the English invaders (at Valcour Island) so that they had to postpone their attack to New York City until the following year which gave the colonials time to meet the invaders at Saratoga.
