Is there nothing that JAG can do to expunge that counseling from your records?

Probably not because a counseling statement, by itself, is not really an adverse action. 

Now, if, in the future, he gets a bad NCOER, he can then file a grievance (like, say he gets a "needs improvement" check in military bearing or a bullet comment that said "not a team player" or something like that.)    I can't remember what the greivance procedures are but they're there, somewhere in the reg.  The grievance would then (in theory) go to a neutral arbiter who would determine whether the NCOER was fair and accurate and if it was determined not to be, the NCOER could be removed from his MPRJ. 

IIRC counseling statements are supposed to be removed from the MPRJ when transferring to a different unit anyway.  Not sure how this works now that everything was on line but I don't recall ever seeing a counseling statement in my 201 file.

BTW, isn't this SSG a reservist anyway?  In my experience you could have unrated time or an NCOER that said you are the biggest sh*tbag in the army and still get promoted at least to E-7 and probably E-8 as long as you show up, have the right MOS and the right schools and your chain-of-command likes you. 

And keep in mind my knowledge of the Reserves was in peacetime when recruiting was easier and the Army was more choosy.  Being at war and having a difficult time recruiting, do you really think the Army is going to take adverse action on someone with a negative counseling statement?  Of course not. 

It was very funny to me going from active duty to the reserve components when seeing the attitude towards NCOERs.  On AD they were life-and-death, and you would stay late or work weekends to get them done, or the chain-of-command would be all over your ass.  In the RC it was more like "hey, if you get a chance, get it done, we need them by next week."  And nobody ever reviewed them for spelling or grammar which is why many of my RC NCOERs look like they were written by a 3rd grader or a non-English speaker.

LOL!!! Oh soooooooo right. However I still maintain the airborne infantry mentality when I was active in my reserve unit. I go to schools and volunteer extra AT time regularly. DFAS is still baffled how I earn leave time in the reserve....LOL. Good news is the 1SG here is being replaced with some one from my reserve unit who knows all about this non sense here.......somebody say KARMA?

I was never looking for attention or an apology I just simply wanted to wear the patch I earned and keep the promise I made to my fallen brothers in doing so. The command here can boast how they lost friends too, but I doubt they had to watch one of their own soldiers or commanding officer die right in front of them. Not to bash anyone here that is not or never was combat arms, but when you spend a year with the same thirty guys in a war zone, that bond you share with your brothers means more to you than anything and when you promise them that you will "NEVER FORGET" then you honor them in your own way. that is what my combat patch means to me and how I choose to honor them, luckily, Army regs support that right, even if a poor command will not.

I have enjoyed and agreed with most of your posts.

I find your disdain of the reserve system a little microscopic and pathetic.

I have 1000 days deployed.  My Company average is *almost* 750 despite some turn over.  The average APFT score is 262 (FY2007).  The average dwell time is down to 19 months.  I have buried one buddy from an OP, and lost several others.  I have 7 reservists with purple hearts.  I have kicked, and check this out, 35 douchebags, kicked them out of the Army with Less Than Honorable for being lazy Soldiers.  Thrown 3 in jail for AWOL/Desertion.  If I get an SSG with a horrible counseling statement, I institute a bar to re-enlistment.

I recruit and retain like nobody's business because my shit hot NCO's know the Old Man throws out the trash, leaving the Joe on your left and right a known entity that can hang.

But what could I possibly know, right?  I'm just a reservist.

Some people have not taken the time to read all the Stars & Stripes articles. They would then realize my first four years were spent with the 173rd as a forward observer (AC) two of them deployed. I still maintain the AIRBORNE infantryman mentality and will not settle for anything less, specially when i am asked to loosen my ARMY VALUES!

You know what really makes my day is when I have to land at other bases to fuel up, people all over Iraq notice who I am and thank me for having the courage in doing what was right. One little letter affected an entire theater of troops. Now soldiers have one less thing to stress about....HA HA!

Like I said early on in this discussion,the coc made a serious error in judgement when they made the combat patch an issue.The wear of the combat patch has always been individual preference and thats how it should be.
